HORIBA Instruments Incorporated / DBA: SPEX Forensics (“HORIBA US,” “we,” “our” or “us”) appreciate your interest in our websites, products and services. We are committed to protecting the privacy of your personal information that we may collect and/or you share with us, such as via our websites or other electronic means, through direct or indirect ordering or inquiries about our products and services, or from information provided at conferences, trade shows, or at our location entry points. This Privacy Statement describes how we collect, use, and share your personal information.
Our business primarily involves collection or solicitation of information between employees of companies for business purposes (“B2B”), not for personal, family or household purposes.
This Privacy Statement does not cover information collected from our employees, job applicants, contractors, or similar individuals, and where noted may exempt other personal information.

We will reasonably give notice as to the purpose and use of personal information collected by us, and will take necessary and appropriate action and supervision for the security control of personal information, including measures to prevent its leak, loss or damage.
We obtain the categories of personal information listed above from the following categories of sources:
• Directly from you. For example, when your visit our Website, or disclose information though our Website (such as when you complete a form, via a message, question, comment or response) or from products and services you purchase.

V. HOW WE MAY SHARE INFORMATION WE COLLECT ABOUT YOU

When we disclose personal information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that personal information confidential and not use it for any purpose except performing the contract. In case of providing personal information of customers to a third party in foreign countries, HORIBA US takes necessary actions for protection of the personal information in accordance with applicable laws and regulations.
HORIBA US select parties who meet requirements in accordance with the internal rules of the HORIBA Group, and also exercise necessary and appropriate supervision over the said service providers and third parties in accordance with applicable laws and regulations.
Except as described above as to our uses or sharing of your personal information, and in cases under applicable law and regulations where your consent is not required, we will get your consent for any use.
We do not sell personal information to third parties.
VI. OUR DATA SECURITY MEASURES
HORIBA US has implemented measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. We make efforts to strengthen the level of our security though reasonable use of encryption based on the Secure Sockets Layer (SSL) schemes or other means to prevent illicit access by third parties.
Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website.
Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website.

Privacy Statement for California Residents
This Privacy Statement for California Residents (“CA Statement”) supplements the information contained in our Privacy Statement and applies solely to all visitors, users, and others who reside in the State of California (“CA Residents”). As a CA Resident, you have additional rights as to your personal information within the scope of the California Consumer Privacy Act of 2018 (CCPA).
When we use the term “personal information” in this supplemental CA Statement, we are using that term as defined in the CCPA, which is “information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household.” However, personal information does not include publicly available, de-identified, or aggregate consumer information as defined in CCPA. Also, the definition of “personal information” does not apply to the collection of personal information from job applicants, employees, contractors – whether you are our employee or any employee of the entity arranging access to our services for you.

In the preceding 12 months, we have disclosed all the categories of personal information as set forth in our Privacy Statement – What Information We Collect About You, but primarily share the following to the extent necessary to achieve the business purpose: name, contact details (addresses, telephone and fax numbers, e-mail addresses, etc.), place of employment, departmental affiliation, job position, information concerning purchased products or services, inquiry histories and other required personal information to the extent necessary to achieve the business purposes stated in our Privacy Statement.
Your Rights and Choices
The CCPA provides CA Residents with specific rights regarding their personal information. This CA Statement describes those CCPA rights and explains how to exercise those rights.
Right to Know
You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request, we will disclose to you:

We do not provide these access rights for B2B personal information.
Right to Delete
You have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete your personal information from our records, unless an exception applies.
We may deny your deletion request if retaining the information is necessary for us or a third party to:
• Complete the transaction for which we collected the personal information, provide a good or service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, fulfill the terms of a written warranty or product recall conducted in accordance with federal law, or otherwise perform our contract with you.
• Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.
• Debug products to identify and repair errors that impair existing intended functionality.
• Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.
• Comply with the California Electronic Communications Privacy Act.
• Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may likely render impossible or seriously impair the research’s achievement, if you previously provided informed consent.
• Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
• Comply with a legal obligation.
• Make other internal and lawful uses of that information that are compatible with the context in which you provided it.
We do not provide these deletion rights for B2B personal information.
Right against Discrimination
We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not:
• Deny you goods or services.
• Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
• Provide you a different level or quality of goods or services.
• Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.
However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.
How to Exercise Your CCPA Rights
To exercise the CCPA rights described above as to your personal information, please submit a verifiable CCPA request to us by emailing us at privacy.US@horiba.com.
Only you, or someone legally authorized to act on your behalf, may make a verifiable CCPA request related to access to your personal information, and no more than twice within a 12-month period. Before responding to, or processing a request, we will first take reasonable steps to first verify your and/or your representative’s identity or authority to make the request, which may include, at a minimum, verifying names, email addresses, account and other sufficient information, and sufficient detail that allows us to properly understand, evaluate, and respond to your request. Making a request does not require you to create an account with us. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.
We endeavor to respond to a verifiable CCPA request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.
We will deliver our written response by mail or electronically, in a format that is readily usable. Any disclosures we provide will only cover the 12-month period preceding the CCPA request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. We do not charge a fee to process or respond to your verifiable CCPA request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

HORIBA US reserves the right to make changes or other revisions to this Privacy Statement at our discretion and at any time. Any such changes will be posted on this Website, or will otherwise be given by notice in accordance with applicable law, as to the noted revision date.
